If you are looking for a ‘no win no fee medical negligence solicitors’ lawyer service there are a few things you need to be aware of
Unfortunately I have had to go down this route three times in the last 7 years, so I have learnt from my mistakes
A celebrity endorsement is no indication of a good service
The first time I was looking for a service I was totally confused, so I picked the service that was endorsed by a celebrity. This celebrity made a name for herself championing causes for the poor, children and the disadvantaged. So I figured that she must have checked this out and I would get a good deal. Turns out that I got a payout that was lower than I feel I deserve and, perhaps more importantly, I had to hand back a significant amount of my pay out in commission fees.
Ensure that you do not end up paying the referral fee
Solicitors are good at getting the compensation but they may not be good at finding customers so they take their customers from brokers. The brokers get paid a fee, the solicitor should pay that fee. Also, that fee is relatively small so the broker my try to bump it up by taking a cut of your compensation pay out, so make sure you don’t have to pay any upfront fees, and that they will not claw back some of your compensation
Remember that they get paid if you win, but it doesn’t matter how little they win
Never accept the first offer, remember they will get paid anyhow, so make them go back and ask for more
They can turn you down
If there is no chance of a win they will turn you down, if that happens ask them to recommend someone who is prepared to take then on, you have nothing to loose
Find out about the insurance and who pays
If there is a chance that they will not win the solicitors will insure their risk so that some of their costs will be covered, under the current system the insurance is paid by the other party if you win and by your solicitors if you lose, (the rules on this may change) make sure that you are not asked to pay this premium, If you are, it is a good sign that you will lose, but the solicitors get paid by the insurance. In my opinion, being asked to pay this insurance is a good sign that you will not win and will end up out of pocket
